1. Acceptance of Terms
By accessing or using USWorkerActions.com (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Platform.
2. Non-Membership and Representation
2.1 Not a Membership Organization: Buildup Cooperative (dba U.S. Workers Alliance) is NOT a membership organization. The Platform is open to all workers who support our mission. Use of the Platform does not make you a member of, affiliate you with, or give you any authority to represent the organization.
2.2 Advocacy vs. Representation: While any individual may advocate for our mission and support our cause, no individual may:
- Represent themselves as part of U.S. Workers Alliance
- Act on behalf of U.S. Workers Alliance
- Claim to represent or speak for the organization
- Bind the organization to any agreement, commitment, or obligation unless they have been specifically designated in writing by Buildup Cooperative.
2.3 Misrepresentation: Representing yourself as part of U.S. Workers Alliance without authorization is a violation of these Terms and may result in account termination and legal action.
3. Purpose of the Platform
USWorkerActions.com is a community and organizing platform for American workers who support the mission of the U.S. Workers Alliance. Our purpose is to:
- Facilitate peaceful, legal, and democratic worker organizing
- Educate workers about their rights under Section 7 of the National Labor Relations Act
- Support the campaign to pass the Comprehensive Labor and Worker Safeguards Act (C.L.A.W.S. Act)
- Build community among workers who believe in real enforcement of labor laws
- Provide resources and information for lawful collective action
3. Eligibility
3.1 Minimum Age: You must be at least 18 years old to use this Platform.
3.2 Worker Status: This Platform is designed for current and former American workers. By using the Platform, you represent that you are or have been a worker in the United States.
3.3 Geographic Restrictions: The Platform is intended for use within the United States. We make no representation that the Platform is appropriate or available for use in other locations.
4. Acceptable Use Policy
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may NOT:
4.1 Illegal Activities: Use the Platform for any illegal purpose, including but not limited to:
- Threats of violence or harm against any person or organization
- Harassment, stalking, or intimidation
- Discrimination based on race, color, religion, sex, national origin, age, disability, or any other protected characteristic
- Fraud or deception
4.2 Workplace Actions: Engage in or encourage any workplace activity that is illegal, including:
- Unauthorized disclosure of confidential or proprietary information
- Sabotage of employer operations or systems
- Violations of lawful employment contracts
- Any activity that would constitute just cause for termination under existing law
4.3 Misrepresentation: Misrepresent your identity, credentials, or employment status, or impersonate any person or entity.
4.4 Spam and Abuse: Send unsolicited messages, spam, or automated requests to other users.
4.5 System Abuse: Attempt to gain unauthorized access to the Platform, interfere with Platform operations, or introduce viruses, malware, or other harmful code.
5. Content and Conduct
5.1 User Content: You are solely responsible for any content you post, share, or transmit on the Platform (“User Content”). By posting User Content, you represent and warrant that:
- You own or have the right to post such content
- The content does not violate any law or these Terms
- The content does not contain confidential or proprietary information belonging to your employer or any third party
5.2 Content Standards: User Content must:
- Be truthful and accurate
- Respect the privacy and confidentiality of others
- Not disclose personal information about others without their consent
- Not contain trade secrets or confidential business information
- Not advocate violence, illegal acts, or workplace misconduct
5.3 Platform Rights: We reserve the right to:
- Remove any content that violates these Terms or our community guidelines
- Suspend or terminate accounts that repeatedly violate these Terms
- Report illegal activities to law enforcement when appropriate
6. Worker Rights and Legal Disclaimer
6.1 Educational Purpose: The Platform provides educational information about worker rights under Section 7 of the NLRA. This information is for educational purposes only and does not constitute legal advice.
6.2 No Attorney-Client Relationship: Use of this Platform does not create an attorney-client relationship. For legal advice regarding your specific situation, consult with a qualified attorney.
6.3 At-Will Employment: In most U.S. states, employment is “at-will,” meaning employers can terminate employees for any legal reason or no reason at all. Nothing on this Platform guarantees your job security or protects you from lawful termination.
6.4 Right to Organize: Section 7 of the NLRA protects certain collective activities, but these protections have limitations. Not all workplace discussions or actions are protected. You should understand your rights and their limitations before engaging in any workplace activity.
6.5 Retaliation Risks: Despite legal protections, employers may retaliate against workers who exercise their rights. While such retaliation may be illegal, it still occurs, and workers should be aware of the risks.
7. Privacy and Data Protection
7.1 Privacy Policy: Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
7.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
8. Intellectual Property
8.1 Platform Content: All content on the Platform, including text, graphics, logos, images, and software, is owned by USWorkerActions.com or our licensors and is protected by copyright and other intellectual property laws.
8.2 Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes consistent with these Terms.
8.3 User Content License: By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute such content in connection with the Platform.
9. Disclaimers
9.1 AS-IS Basis: THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.2 No Guarantee: We do not guarantee that the Platform will be uninterrupted, secure, or error-free, or that defects will be corrected.
9.3 No Legal Protection Guarantee: Nothing on this Platform guarantees that you will be protected from employer retaliation, that your rights will be enforced, or that any legal action will be successful.
10. Limitation of Liability
10.1 Maximum Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, USWORKERACTIONS.COM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE PLATFORM.
10.2 Total Liability: IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED DOLLARS ($100.00).
10.3 Employment-Related Claims: WE ARE NOT LIABLE FOR ANY EMPLOYMENT-RELATED DECISIONS MADE BY YOUR EMPLOYER, INCLUDING TERMINATION, DEMOTION, DISCIPLINE, OR ANY OTHER ADVERSE EMPLOYMENT ACTION.
11. Indemnification
You agree to indemnify, defend, and hold harmless USWorkerActions.com and our affiliates, officers, directors, employees, agents, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your User Content
12. Political Activity
12.1 Non-Profit Status: USWorkerActions.com is operated by Buildup Cooperative (dba U.S. Workers Alliance), a 501(c)4 organization pending approval.
12.2 Educational Focus: The Platform provides educational information about worker rights and advocates for legislative reform. This is consistent with our 501(c)4 mission.
12.3 No Endorsements: Unless explicitly stated, the Platform does not endorse any specific candidate for public office. We may provide information about candidates’ positions on worker rights issues.
13. User Accounts
13.1 Account Creation: You may be required to create an account to access certain features of the Platform. You agree to provide accurate, current, and complete information during registration.
13.2 Account Termination: We reserve the right to suspend or terminate your account at any time, with or without cause, with or without notice.
13.3 Account Security: You are responsible for maintaining the confidentiality of your password and account information.
14. Modification of Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the revised Terms on the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Terms.
15. Governing Law and Dispute Resolution
15.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Nevada, without regard to its conflict of law principles.
15.2 Dispute Resolution: Any dispute arising from or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Clark County, Nevada.
15.3 Class Action Waiver: YOU AND USWORKERACTIONS.COM AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THE PARTY’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
16. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and USWorkerActions.com regarding your use of the Platform.
